Terms of Service

3.1 Account Creation

You must create an account to use our Services. You agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Types

• Influencer Accounts: For creators who want to monetize their digital likeness
• Brand Accounts: For businesses seeking to rent influencer cameos for content creation

4.1 For Influencers

As an influencer, you may:

• Create a profile with your Sora username (from sora.chatgpt.com)
• Upload sample videos showcasing your cameo quality (created on sora.chatgpt.com)
• Set monthly rental pricing for your digital likeness
• Define usage restrictions (content types, industries, etc.)
• Review and approve/decline brand rental requests
• Manage your Sora whitelist on sora.chatgpt.com to grant access to approved brands
• Receive monthly payments for active subscriptions

4.2 For Brands

As a brand, you may:

• Browse and search the marketplace of influencer cameos
• Filter by niche, audience size, pricing, and restrictions
• Apply to rent influencer cameos
• Subscribe to monthly billing for approved cameo rentals
• Create unlimited videos on sora.chatgpt.com using rented cameos (subject to usage restrictions set by influencers)
• Cancel subscriptions at any time

5.1 Application and Approval

• Brands apply to rent an influencer's cameo and are charged for the first month upon application
• Influencers receive notifications and can review brand profiles
• Influencers approve or decline requests at their discretion
• If an influencer does not accept a rental request within 7 days, the brand receives a complete refund of the first month's payment and the subscription is cancelled immediately
• Upon approval, influencers must add the brand to their Sora whitelist on sora.chatgpt.com
• Brands gain access to create content on sora.chatgpt.com once whitelisted by the influencer

5.2 Subscription and Billing

• Rentals operate on a monthly subscription basis
• Subscriptions auto-renew monthly unless cancelled
• Brands are billed on the same day each month from their application date
• All payments are processed securely through Stripe

5.3 Cancellations

• Brands may cancel subscriptions at any time through their dashboard
• Influencers will be notified to remove brands from their Sora whitelist on sora.chatgpt.com
• Access ends at the end of the current billing period
• Influencers who remove their listing lose all active revenue streams

6.1 Platform Fees

RentMyCameo charges a service fee on all transactions. The current fee structure will be displayed during the rental process. We reserve the right to modify our fees with advance notice.

6.2 Influencer Payouts

• Influencers receive monthly payments for each active brand subscription
• Payment is processed after the brand successfully uses the cameo without issues during the rental period
• Payouts are processed through Stripe Connect
• Influencers must have a valid Stripe Connect account to receive payments
• Payment may be withheld if usage violations are reported

6.3 Refunds

All sales are final. Refunds may only be issued in cases of platform error, fraud, or as required by law. Cancellations do not result in refunds for the current billing period.

7.1 Influencer-Defined Restrictions

Influencers may define usage restrictions including acceptable content types, industries, and use cases. Brands must respect these restrictions when creating content.

7.2 Prohibited Uses

All users are prohibited from:

• Creating content that is illegal, fraudulent, defamatory, or harmful
• Violating any third-party rights including intellectual property rights
• Creating misleading or deceptive content
• Using cameos for political campaigns without explicit consent
• Creating adult, violent, or hate speech content
• Attempting to circumvent platform fees or payment systems
• Sharing access credentials with unauthorized parties

7.3 Compliance with Sora Platform Policies

All users must comply with sora.chatgpt.com's terms of service and usage policies when using that platform. RentMyCameo is not responsible for enforcing Sora's policies or for any violations, content issues, or disputes that occur on sora.chatgpt.com. Users are solely responsible for their activities on external platforms.

8.1 Platform Rights

RentMyCameo and its licensors own all rights, title, and interest in the platform, including all intellectual property rights. You may not copy, modify, or create derivative works of our platform.

8.2 User Content

You retain ownership of content you upload (profile information, videos, etc.). By uploading content, you grant RentMyCameo a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content for platform operation purposes.

8.3 Likeness Rights and Sora Platform Disclaimer

Influencers grant brands a limited license to use their Sora username to access their cameo on sora.chatgpt.com for the duration of the active subscription, subject to defined usage restrictions. This license terminates upon subscription cancellation.

Important: Your cameo (digital representation of likeness and voice) is created, hosted, and managed entirely on sora.chatgpt.com. RentMyCameo does not create, host, or have control over cameos. We are not responsible for the quality, accuracy, functionality, or any issues with cameos on sora.chatgpt.com. All cameo-related technical issues must be addressed directly with Sora/OpenAI.

9.1 Dispute Reporting

If a brand violates usage restrictions or if there are issues with content quality or access, users should report disputes through our support system.

9.2 Platform Mediation

RentMyCameo will mediate disputes between brands and influencers. We may withhold payments, suspend accounts, or take other action pending resolution.

9.3 Arbitration

Any disputes arising from these Terms or use of our Services shall be resolved through binding arbitration rather than in court, except where prohibited by law.

10.1 No Responsibility for Sora Activities

RentMyCameo is NOT responsible for:

• Any content created, generated, or published on sora.chatgpt.com
• The quality, accuracy, or functionality of cameos on Sora
• Technical issues, downtime, or service interruptions on Sora
• Sora's terms of service, policies, or policy changes
• Access issues, account suspensions, or bans on Sora
• Any disputes, violations, or legal issues arising from Sora usage
• Changes to Sora's features, pricing, or availability
• Data privacy or security on the Sora platform

10.2 User Responsibility

You acknowledge that your cameo setup, whitelist management, and all content generation activities occur entirely on sora.chatgpt.com, which is a separate platform operated by OpenAI. You are solely responsible for:

• Maintaining your Sora account and cameo setup
• Complying with Sora's terms of service and policies
• Managing access permissions and whitelists on Sora
• Addressing any technical or quality issues with your cameo directly with Sora/OpenAI
• Any content created using your cameo or cameos you have access to

10.3 Platform Scope

RentMyCameo's services are limited to:

• Providing a marketplace for listing and discovering cameos
• Facilitating rental agreements between users
• Processing payments and subscriptions
• Managing user accounts and profiles on our platform
• Mediating disputes related to our platform services only

13.1 Termination by You

You may close your account at any time. Active subscriptions will continue until the end of the current billing period.

13.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will provide notice when possible.

15.1 Entire Agreement

These Terms constitute the entire agreement between you and RentMyCameo regarding use of the Services.

15.2 Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in full effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
